Welcome to the website of Norwex Malaysia Snd. Bhd., ("Norwex", "we" or "us").

The following terms and conditions, together with any other extracts, agreements, documents or policies referred to, are expressly incorporated herein (collectively "Terms") and apply to your use of norwex.my and any sub-domains thereof, including any content, downloads, catalogues, functionality, Products and services offered on or through norwex.my ("website"), as well as in regards to any purchases you make via the website ("Purchase(s)/ed”) of any Norwex Products or services ("Product(s)”).

Please read these Terms carefully before you access or otherwise start to use the website or transact any Purchases by using the website and or completing any Purchases, you accept and agree to abide by these Terms, which can be found at www.norwex.my. If you do not agree to these Terms or the Privacy Policy, whether in whole or in part, you must exit the website and/or refrain from ordering any Purchases.

1. Change to the terms

We may, in our sole discretion, revise and update these Terms from time to time. You must check this page from time to time to take notice of any changes we make, as they are binding on you. Your continued use of the website or ordering of any Products following the posting of any revised Terms means that you accept and agree to the changes.

2. Online Purchase Terms

The following clauses relate to all Purchases made through the website.

2.1 How To Order Purchases Through The website

After placing an order, you will receive an email from us acknowledging that we have received your order ("Order Confirmation"). Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product, also known as an ‘invitation to treat'. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email confirming the shipment of your order ("Shipment Confirmation").

A contract with us will only be formed when we send you the Shipment Confirmation. The contract will relate only to those Products whose shipment we have confirmed in the Shipment Confirmation. We will not be obliged to supply any other Products which may have been part of your order in a separate Order Confirmation. We reserve the right to cancel your order at any time before we have accepted it and we may rescind our acceptance and cancel your order where there has been an obvious error in price or where the Product is no longer in our inventory.

2.2 Price & Availability of Products

Prices, the specifications as well as the availability of Products on the website are subject to change without notice. Errors will be corrected when discovered. Our website contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our website may be incorrectly priced. We will normally verify prices as part of our Shipment procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when shipping the Product to you.

If a Product's correct price is higher than the price stated on our website, we will normally, at our discretion, either contact you for instructions before shipping the Product, or reject your order and notify you of such rejection. We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you an Order Confirmation or a Shipment Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a pricing error.

2.3 Out of Stock Products

On occasion, you may be able to place a Product in your shopping cart and submit your order for processing, but your order is subsequently cancelled due to the unavailability of the Product. You acknowledge that Products may sell quickly and there may be a short period of time after an order has been submitted, during which the Product is no longer available. You agree that we may cancel your order after you have received an Order Confirmation without penalty.

2.4 Discontinued Products

On very rare occasions, you may receive a Shipment Confirmation from us, but the Product is no longer available in our inventory. You agree that we may rescind our acceptance and cancel your order without penalty if we are unable to ship the Product you ordered due to such unavailability.

3. Shipment & Delivery

Products can be shipped only to a street address within Malaysia.

The term ‘shipping' or ‘ship' includes the commencement of shipping Product in an order for multiple Purchases or where the Product purchased consists of components that must be shipped separately. For example, your order may consist of (1) several different Product(s), (2) a quantity of the same Product, or, (3) a single Product with several component parts the size of which might require them to be shipped in separate packages. In all such orders, we endeavour to ship out individual packages together so that they arrive at the same time; however, when that is not possible, we commence shipping by shipping individual packages in the order the soonest they are available and conditions permit. In these instances, our notification to you that your order has ”shipped,” marks the time when shipping has commenced; it does not mean that all Product in the order have shipped at that time. You agree that credit cards and debit cards are to be charged on the date of inventory reservation for the order, not the date of shipping.

Your order will be fulfilled by the estimated delivery date set out in the Shipment Confirmation, or as otherwise set out on the website. If we are unable to meet the estimated delivery date, we will contact you with a revised estimated delivery date.

Please note that unless otherwise stated on the website, delivery estimates are just that. They are not guaranteed delivery times and should not be relied upon as such.

3.1 Non-Deliverable Orders

In some cases, an order may be returned to Norwex if the carrier is unable to deliver it to the specified shipping address due to no fault of Norwex. In such cases and at your request, Norwex will attempt to re-ship the Products. Please be aware that you will be charged the delivery cost for both the original failed shipment and any subsequent delivery or attempted delivery.

3.2 Product Return Policy

If for any reason you are not completely satisfied with any Norwex Product, you or the Norwex consultant may return the unused portion of the Product within 60 (sixty) days from the date of Purchase provided that a completed Return Form and the original Customer Order Form with Purchase date accompanies the Products. For Products returned pursuant to this policy, Norwex will, at your option:

  1. refund the amounts paid for the Products by crediting 100% of the Purchase price (less shipping and handling charges) and sales tax by (i) check or (ii) on the credit card used to make the Purchase; or
  2. exchange the returned Product for a Product of equal or lesser value as selected by you. The original order will be refunded and a new order will be submitted, as well as applicable sales tax and shipping and handling charges.

To cancel an order or contract, please contact your Norwex Consultant or our Customer Services telephone line or e-mail us at my-info@norwex.com to tell us. You may wish to keep a copy of your cancellation notification for your own records. If you send us your cancellation notice by e-mail or by post, then your cancellation is effective from the date you sent us the e-mail or posted the letter to us.

3.3 Risk of Loss; Title

All Product Purchased from our website are made pursuant to a shipment contract. This means that, subject to payment of the Products in full, the risk of loss and title for such Product(s) pass to you upon Norwex's tender of the Product to the carrier.

3.4 Withdrawal of Products

We reserve the right to withdraw any Product from this website at any time and/or remove or edit any materials or content on this website. Whilst we will make our best efforts to always process all the orders, there may be exceptional circumstances which mean that we may need to refuse to process an order after we have sent you an Order Confirmation, which we reserve the right to do at any time, at our sole discretion. We will not be liable to you or any other third party by reason of our withdrawing any Product from this website, whether it has been sold or not, removing or editing any materials or contents on this website or for refusing to process or accept an order after we have sent you the Order Confirmation.

3.5 Warranties – Products

Norwex clearly displays Product warranties alongside or near the actual Product to which the warranty relates. If no such Product warranty is displayed, in the alternative, Norwex provides a default warranty period of 60 days for Products.

4. Our privacy standards

The Norwex Group ("we / us / our”) respects and is committed to protecting your privacy through our compliance with this policy.

This policy (together with our terms of use and any other documents referred to in it) describes the personal information that we collect from you, or that you provide on our Websites www.norwex.my (our "Websites”) and how that information may be used or disclosed by us. We comply with the regulations of the Malaysian Personal Data Protection Act 2010 ("PDPA"), its regulations, standards and applicable guidelines.

This policy does not apply to information collected on any third-party site. We inform you about third-party applications that may be active on our website, see 4.b below ("third party applications”).

Please read the following carefully to understand our policies and practices regarding your personal information and how we will treat it.

4.1 Accessing the website

Our Websites are not intended for use by children under 18 years of age. No one under age 18 may provide any personal information to or on the Websites. We do not knowingly collect personal information from children under 18. If you are under 18, please do not register on the Websites, make any purchases through the Websites or send any information about yourself to us. In the event that we learn that we have collected personal information from a child under age 18 without verification of parental consent, we will delete that information. 4.2 Information we collect

a. Internet usage related information

We collect several types of information from and about users of our Websites, including: information you provide to us, that we collect as you navigate through the Websites, – traffic and location data, IP addresses, usage details through the use of certain technologies, including cookies and web beacons.

aa. IP Addresses

We collect details of your visits to our Websites. We only collect aggregate information, such as, for example, traffc data, logs and other communication data. The information we collect concerns the resources that you access, information about your computer and internet connection, including your IP address, operating system and browser type.

bb. Cookies

Cookies are small files stored on the browser or the hard drive of your computer. Use of cookies help us to improve our Websites and to deliver a better and more personalised service by enabling us to: estimate our audience size and usage patterns, store information about your preferences, allowing us to customise our Websites according to your individual interests, speed up your searches and recognise you when you return to our Websites.

If we have informed you about cookie functionalities and you register with us or you continue to use our Websites, you agree to our use of cookies.

You can refuse to accept cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Websites. cc. Web Beacons

Web beacons (also known as pixel tags) are electronic images, contained on Websites that permit us to count users who have visited those pages and for other related Websites statistics (for example, recording the popularity of certain Websites content and verifying system and server integrity). Web beacons are not used to access your personal information on the Websites and are only used to compile aggregated statistics concerning use of the Websites.

b. Information required to deliver our services

We may collect and use the following information that you provide to us:

Information that you provide by filling in forms on our Websites. This includes information provided at the time of registering to use our Websites, subscribing to our services, posting material or requesting further services or information. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Websites;

Records and copies of your correspondence (including e-mail addresses), if you contact us.

Your responses to surveys that we might ask you to complete for research purposes, although you do not have to respond to them.

Details of transactions you carry out through our Websites and of the fulfilment of your orders. You may be required to provide financial information before placing an order through our Websites.

The failure to supply and/or consent to the collection and the processing of the information will results in us being unable to fulfil your request, offer you a full response, as well as provide you with the information, notices, services and / or products requested. Such a failure to provide the obligatory personal data will also affect the ability of the parties to enter into the necessary agreement in relation to the provision of our services to you.

We use information that we collect about you or that you provide to us, including any personal information, in the following ways:

d. Information required to deliver our services

To carry out our contractual obligations, process and enforce our rights arising from any contracts entered into between you and us.

aa. Opt-in consent

We will use your data for direct marketing activities where you have given an opt-in informed consent (which means that you have given us an express and informed consent to receive promotional information via email and sms).

bb. Existing customers

If you are an existing customer we will send you Email and/or sms for direct advertising of our own similar goods or services if we have obtained your Email and/or sms data in connection with the sale of goods or services; and you have not objected to this use.

You will be clearly and unequivocally advised, when the address is recorded and each time it is used, that you can object to such use at any time, without costs arising by virtue thereof, other than transmission costs pursuant to the basic rates.

cc. Opt-out procedures / unsubscribing

You can also always opt-out of receiving e-mail information from us other than the e-mail informing you of the completion of user registration, correction of user data, or change of password by sending us an e-mail stating your request to my-info@norwex.com.

If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions. Such unsubscribe requests will be honoured within less than ten (10) business days of such request and your data will be deleted. This opt out does not apply to information provided to Norwex as a result of a product downloads or purchase, warranty registration, product service experience or other transactions.

f. Sensitive data

Any collection, processing and use of sensitive data (such as health data, religious belief, and political opinion) will require your express consent.

4.4 Disclosure of your information to third parties

a. Third parties / customer data. Data recipients

We only disclose personal information that you provide via this Website

- where necessary to fulfil the contractual obligations or

- where you have given your informed consent To the following third parties:

  • To a member of our group – holding company and its subsidiaries and affliates; and
  • Direct contractors and service providers we use to support our business

Such third parties may be located outside of Malaysia which may not guarantee the same level of protection for personal information as the one in which you reside. By using this Website, you give your consent to our processing of your personal data in accordance with this Privacy Policy, including but not limited to the processing by the third parties who may be located outside of Malaysia.

In the event (whether prospective or actual) of a merger, acquisition, or any form of sale of some or all of Norwex's assets, in which case personal information held by Norwex's about its customers will be among the assets transferred to the (prospective) buyer.

We may also disclose your personal information to third parties to the extent that it is permissible under the PDPA, its regulations and applicable guidelines.

bb. Transfer standards

Where we commission a third party contractor to provide services on our behalf in accordance with our instructions, then, in addition to a service agreement comprising the work to be performed, the agreement will also refer to the obligations of the contractor as the party commissioned to process the data. These obligations shall set out the instructions of the customer concerning the type and manner of processing of the personal data, the purpose of processing and the technical and organisational measures required for data protection in order to make sure that the standards of our data policy will apply to the third party, too.

The contractor will not be allowed to use the personal data (entrusted to it for performing the order) for its own or third-party processing purposes.

cc. Malaysian data processing standards

Norwex will gather express consent from any individual before transferring data to bodies that are headquartered in a third country or that transfer data across national borders.

Steps shall be taken to ensure that this data is transmitted properly. Appropriate data privacy and data security requirements shall be agreed with the recipient before data is transmitted.

b. Third Party Applications / advertising

Third party applications may be available via the website. The owners of these applications ("Third Party Owners”) may collect personally identifiable information from you and may have their own policies and practices. We will inform you about such applications, but we are not responsible for the policies or the practices of Third Party Owners or how they or their applications use your personally identifiable information. These Third Party Owners may have their own terms of service, privacy policies or other policies and ask you to agree to the same. Our website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google”). 4.5 Data security

g. Data security standards

We have implemented measures designed to secure your personal information from accidental loss and from unauthorised access, use, alteration and disclosure in accordance with Section 9 sentence 1 BDSG and Appendix. We take reasonable precautions to ensure that data collected from you is reliable, accurate, complete and current. All information you provide to us is stored on secure servers behind firewalls. All payment transactions you make via our website are encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Websites like message boards. The information you share in public areas may be viewed by any user of the Websites.

h. Transmission via Internet

Unfortunately, the standard non-SSL-transmission of information via the internet is not encrypted. 5. DISCLAIMER OF WARRANTIES – PRODUCTS

Except as set out above ‘Warranties – Products', Norwex hereby disclaims all warranties of any kind, either express or implied, statutory or otherwise, including but not limited to any warranties of merchantability, non-infringement and fitness for particular purpose.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

5.1 Limitation on Liability – Products

In no event will norwex, its subsiduaries, affiliates, licensors, service providers, employees, agents, officers and/or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the website, any websites linked to it, any content on the website or such other websites or any services or items obtained through the website or such other websites, including for any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss or corruption of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

5.2 Indemnification – Products

You agree to defend, indemnify and hold harmless Norwex, its affiliates and licensors and their respective officers, directors, employees, contractors, agents, licensors and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) resulting from your violation of these Terms or your (i) unauthorised use of the Products, and/or (ii) use of the Products otherwise then as instructed, other than as expressly authorized in these Terms.

6. Intellectual Property Rights

The entire contents of the website (including all downloads, information, software, text, displays, catalogues, images, video and audio) and the design, selection and arrangement thereof, are owned by Norwex or its licensors and are protected by Malaysia, United States, Canada, European Union and international laws regarding copyrights, patents, trademarks, trade secrets and other intellectual property, industrial or proprietary rights.

You are permitted to use the website for your personal or legitimate business purposes. Except where explicitly authorised by Norwex you must not copy, modify, create derivative works of, publicly display or perform, republish, download or store, or transmit any of the material on our website, or the website itself without the prior written consent of Norwex in each instance.

You must not:

  • Modify the paper or digital copies of any materials available from this website; or
  • Use any illustrations, photographs, video or audio sequences or any graphics separately from the accompanying text;

7. Norwex's Trademarks

Norwex's name, trademarks, Norwex's logo and all related names, logos, Product and service names, designs and slogans are trademarks of Norwex, its affiliates or licensors. You must not use such marks without the prior written permission of Norwex. All other names, brands and marks are used for identification purposes only and are the trademarks of their respective owners.

8. Prohibited Uses

You may use the website only for lawful purposes and in accordance with these Terms.

You agree not to use the website (to):

In any way that violates any applicable federal, state, local and international law or regulation (including, without limitation, any laws regarding the export of data or software to and from Malaysia, the US, Canada, EU or other countries); or

Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, pornographic, hateful or unlawful, content, material or information;

To impersonate or attempt to impersonate Norwex or a Norwex employee, another user, or person or entity (including, without limitation, the use of email addresses associated with any of the foregoing);

To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the website, or which, as determined by us, may harm Norwex or users of the website or expose them to liability;

Harvest or otherwise collect information about others, including email addresses, without their consent;

Attempt to gain unauthorized access to, interfere with, damage, overburden or disrupt any parts of the website, the server on which the website is stored, or any server, computer or database connected to the website; or attack the website via a denial-of-service attack or a distributed denial-of-service attack; or otherwise attempt to interfere with the proper working of the website.

The website may contain message boards, chat services, forums, blogs, bulletin boards and other interactive features (collectively, "Interactive Services") that allow you to post, submit, publish, display or transmit to other users content or materials including, without any limitation whatsoever, any feedback, chat logs, forum logs, emails, pictures, screenshots, or any communication whatsoever that you create from and / or insert, append, attach or otherwise upload to the Interactive Services (collectively, "User Contributions") on or through the website. All User Contributions must comply with the Content Standards set out in these Terms.

Any User Contributions you post to the website will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose.

You represent and warrant that (i) you own or control all rights in and to the User Contributions and have the right to grant Norwex and its affiliates the license granted above; and (ii) that all of your User Contributions do and will comply with these Terms, and you agree to defend, indemnify and hold harmless Norwex and its affiliates and licensors for any breach of that representation and warranty.

You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not Norwex, have full responsibility for such content, including its legality, reliability, accuracy and appropriateness. Any content and/or opinions uploaded, expressed or submitted to the website, and all articles and responses to questions and other content, other than the content provided by Norwex, are solely the opinions and the responsibility of the person or entity submitting them and do not necessarily reflect the opinion of Norwex. We are not responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the website.

You represent and warrant that (i) you own or control all rights in and to the User Contributions and have the right to grant Norwex and its affiliates the license granted above; and (ii) that all of your User Contributions do and will comply with these Terms, and you agree to defend, indemnify and hold harmless Norwex and its affiliates and licensors for any breach of that representation and warranty.

9.1 User Contributions – Enforcement; Termination

We have the right, at our sole discretion to:

Remove, edit or refuse to post any User Contributions for any reason; or

Take any action with respect to any User Contribution that we deem necessary, if we believe that such User Contributions violates the Terms, including the Content Standards, infringes any intellectual property right, or could create liability for Norwex;

Disclose your identity to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy;
